Yorvanky Pérez’s desire to stay in Costa Rica got dimmer following a decision Friday denying him asylum.

The resolution DJAP-RE-002-14 of the Ministry of Foreign Affairs (Ministerio de Relaciones Exteriores) stated the denial, supported by Article 31 of the Costa Rican Constitution, which refers to the concensión or denial of asylum status.

Pérez must now wait a decision by Costa Rica’s immigration officials and the acceptance by a third country, according to his lawyer.

The Cuban national was denied entry into Costa Rica on April 24 and has been living in the hallways of the Juan Santamaría (San José) airport since. He was detained when he tried to enter country with an expired “refugee” permit.

Pérez has been on a hunger strike for the past two weeks and is health condition is delicate, say airport officials.

The denial for asylum follows two other denials for refugee status, one by the Comisión de Visas and the other by the Tribunal Administrativo Migratorio.
